Clarification Text for Users

This Clarification Text has been prepared by Fotokart — Süreyya Erişkin (“Fotokart”), acting in the capacity of data controller, to provide explanations and information regarding the processing of personal data of Fotokart customers/users in accordance with the Personal Data Protection Law No. 6698 (“Law”).

1. Purpose of Processing Personal Data

Your personal data collected by Fotokart will be processed within the scope of personal data processing conditions and purposes specified in Articles 5 and 6 of the Law for the following purposes. Within the scope of planning and executing necessary activities for customizing and promoting products and services offered by Fotokart according to the preferences, usage habits, and needs of relevant persons:

– Planning and/or executing customer/user satisfaction activities
– Planning and/or executing market research activities for sales and marketing of products and services
– Planning and/or executing marketing processes of products and/or services
– Planning and/or executing relevant processes to obtain maximum benefit from products or services offered by Fotokart

Within the scope of conducting necessary work by our business units and executing relevant business processes to benefit relevant persons from products and services offered by Fotokart:

– Planning and/or executing sales processes of products and/or services
– Planning and/or executing after-sales support service activities
– Planning and/or executing customer/user relationship management processes
– Tracking customer/user requests and/or complaints
– Tracking contractual processes and/or legal claims

Within the scope of ensuring legal, technical, and commercial business security of Fotokart and relevant persons in business relationship with it:

– Planning and/or executing Fotokart audit activities
– Planning and executing necessary operational activities to ensure Fotokart activities are conducted in accordance with company procedures and/or relevant legislation
– Ensuring security of Fotokart operations
– Ensuring data accuracy and currency
– Providing information to authorized institutions as required by legislation

Within the scope of conducting necessary work by our relevant business units for execution of commercial activities carried out by Fotokart and executing related business processes:

– Planning, auditing, and executing information security processes
– Establishing and managing information technology infrastructure
– Tracking finance and/or accounting operations
– Tracking legal affairs
– Planning and/or executing activities for efficiency/productivity and/or appropriateness analysis of business activities
– Planning and executing business activities
– Planning and executing corporate communication activities
– Planning and executing logistics activities
– Planning and executing production and/or operation processes

Within the scope of planning and executing Fotokart’s commercial and/or business strategies:

– Managing relationships with business partners and/or suppliers
– Executing strategic planning activities
– Planning and tracking performance evaluation processes of business partners and/or suppliers

2. Parties to Whom Personal Data May Be Transferred and Purpose of Transfer

Your personal data collected by Fotokart may be shared with legally authorized public institutions and private persons and other persons within the framework of personal data processing conditions and purposes specified in Articles 8 and 9 of the Law for the purposes of planning and executing the Company’s commercial and/or business strategies, conducting necessary work by our relevant business units for execution of commercial activities carried out by the Company and executing related business processes, ensuring legal, technical and commercial business security of the Company and relevant persons in business relationship with the Company, conducting necessary work by our business units and executing relevant business processes to benefit relevant persons from products and services offered by the Company.

3. Method and Legal Basis of Personal Data Collection

Your personal data is collected by Fotokart electronically through email and social media accounts that you allow Fotokart to access through relevant websites and/or through the call center. Your personal data may also be processed and shared within the scope of personal data processing conditions and purposes specified in Articles 5 and 6 of the Law and for the legal reasons and purposes specified in Articles 1 and 2 of this Privacy Notice and Consent Text.

4. Personal Data Processed by Fotokart Based on Your Explicit Consent and Processing Purposes

Fotokart may process your personal data specified below for the purposes specified below, within the scope of your explicit consent provided by approving this Privacy Notice and Consent Text.

– Your identity information, contact information, customer and customer transaction information, and marketing information shared within the scope of your legal relationship with Fotokart may be processed and shared for the purposes of planning and executing product and service marketing processes and planning and executing relevant processes to obtain maximum benefit from products and services offered by the company, including sending email notifications by Fotokart, determining user habits for targeting, profiling and analysis, offering discounted campaigns, providing personalized content, digital marketing, remarketing, advertising, planning and developing Fotokart business and strategies through evaluation, analysis and optimization activities related to advertisements made to you, conducting market research and surveys within the scope of planning and executing market research activities for sales and marketing of products and services offered by the company.

– Additionally, your user information such as username, order information, address, etc., shared within the scope of your legal relationship with Fotokart, may be shared with suppliers for planning and executing supplier performance management processes and preventing fraudulent activities.

5. Rights of Personal Data Subject

Under Article 11 of the Law, as personal data subjects, you have been granted the following rights:

– Learning whether your personal data is processed
– Requesting information if your personal data has been processed
– Learning the purpose of processing your personal data and whether they are used in accordance with their purpose
– Knowing the third parties to whom your personal data is transferred domestically or abroad
– Requesting correction of your personal data if it is incomplete or incorrectly processed and requesting notification of such action to third parties to whom personal data has been transferred
– Requesting deletion or destruction of your personal data if the reasons requiring their processing have disappeared, despite being processed in accordance with Law No. 6698 and other relevant law provisions, and requesting notification of such action to third parties to whom personal data has been transferred
– Objecting to the occurrence of any result that is to your detriment by means of analysis of your processed data exclusively through automated systems
– Requesting compensation for damages if you suffer damage due to unlawful processing of your personal data

As personal data subjects, you can submit your requests regarding your rights to Fotokart through the methods specified in the User Agreement at www.fotokart.shop.
Fotokart will finalize the request free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, Fotokart reserves the right to charge a fee based on the tariff determined by the Personal Data Protection Board.
